Your entire liability and your exclusive remedy shall be no more than the amount paid for the particular product (machine). This Agreement shall be governed by the laws applied by courts of the State of Texas.
Breach of Agreement
You agree to indemnify and hold New Ice Age Corp. and its successors harmless from and against any damages or liability of any kind arising from your use of the product (machine) in any form, any breach of the terms and conditions of this Agreement, or your negligent act, omission or willful misconduct. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. Any or all rights granted pursuant to this Agreement shall automatically terminate upon your breach of this Agreement.
No Representation
New Ice Age Corp. , referred to as The Company, has not made any representation or warranty as to the accuracy or completeness of this information. The Company shall not have any liability to arising from the delivery or use of the information, except to the extent expressly set forth in any definitive written agreement that parties may execute in the future. The financial performance of the machine or machines which is/are the subject of future Agreements will depend entirely on the buyers efforts to select a suitable location and promote and manage the machine or machines; and The Company makes no promise that an machine will meet or exceed the performance of the machines which are the subject of the pro-forma information disseminated by The Company.
